Can your disability income be garnished?

Social Security benefits and Social Security Disability Insurance (SSDI) payments can be garnished to pay child support and alimony; court-ordered restitution to a crime victim; back taxes; and non-tax debt owed to a federal agency, such as student loans or some federally funded home loans.

Can New York State garnish my Social Security?

Generally speaking, government-administered benefits, such as state pensions and Social Security benefits, cannot be garnished by a judgment.

Can SSDI be garnished for state taxes?

If a person receiving any form of Social Security, including SSDI or SSI, is garnished by a state tax collector, twice the amount of monthly Social Security deposited into a bank account is automatically protected from garnishment, no matter the source of funds in the account at that time.

How much can be garnished from SSDI?

The maximum amount that can be garnished is 50 percent of your Social Security benefit if you support another child, 60 percent if you don’t support another child, or 65 percent if the support is more than 12 weeks in arrears.

Can a Social Security disability check be garnished?

If you receive Social Security disability benefits, you’re likely (and very understandably) protective of your entitlement. As a result, it’s important to understand whether Social Security benefits are generally safeguarded from garnishment under the law or whether a portion of your benefits may be claimed by creditors to pay down your debts.

How are Social Security benefits taxed in New York?

New York also exempts Tier 1 railroad retirement benefits from income tax. If you paid tax on these benefits to the Internal Revenue Service, you must deduct them from your New York adjusted gross income when you file your state tax return. Social Security cannot withhold any federal income tax from your Social Security benefits.

Can a social security garnishment be used for alimony?

We can withhold Social Security benefits to enforce your legal obligation to pay child support, alimony or restitution. State laws determine a valid garnishment order. By law, we garnish current and continuing monthly benefits. We do not make retroactive adjustments.  You cannot appeal to Social Security for implementing garnishment orders.
