Do employers automatically send W-2?

By Emily Wilson |

Employers send employees a Form W-2 in January (and a copy to the IRS). Employees use Form W-2 to prepare their tax returns. Every employer that paid you at least $600 during the year has to provide you with a W-2 and send a copy to the IRS and the state.

Does everyone receive a W-2 form Why or why not?

You should only receive a W-2 if you are an employee. If you are an independent contractor or self-employed, the work you do may be the same as an employee, but you will receive an earnings statement on a Form 1099 rather than a W-2. The W-2 form is divided into boxes that report various items relating to your income.

What happens if my employer doesn’t give me a W-2?

Form 4852. The IRS will send your boss a special form noting that you did not receive your W-2. If, even after nudging from the IRS, your employer doesn’t send you a replacement W-2 in time for you to file your tax return, you may file using Form 4852 in place of your missing wage statement.

When to send out W2 forms to employees?

Send W-2 forms for all employees to the Social Security Administration (SSA) by the same date (January 31 of the year after the tax year). 2 The deadline is the same for giving the W-2 to employees and filing it with the SSA. This is a good reason to give employees their forms early in January so that you can find and fix errors before filing.

Do you have to fill out a W-9 if you are an employee?

If you’re misclassified as an independent contractor, your employer’s “savings” will come out of your pocket. If you’re an employee, you should fill out form W-4, not form W-9. (See The Purpose of the IRS W-4 Form for more information.)

What to do if you don’t have a W-2 form?

If the tax deadline is looming and you still do not have the missing W-2, you can use Form 4852, “Substitute for Form W-2.” The IRS normally sends you a copy of this form after you contact it for assistance. You enter your estimated income and withholding on the form and attach it to your tax return.

Do you have to file a W-2 if you are an independent contractor?

If your employer considered you an independent contractor rather than an employee, it doesn’t have to issue a W-2. Instead it will issue a Form 1099-MISC, Miscellaneous Income, if it paid you $600 or more during the year.
