Do I still have to pay my wife after divorce?

After the divorce is final, financial obligations between spouses may continue. One spouse may have to pay the other on a monthly basis for spousal maintenance or child support payment. Or, a spouse may be required to maintain insurance for the benefit of the former spouse.

Do I have to pay maintenance for my ex wife?

In short, there is a common law duty imposed upon spouses to support each other whilst the marriage/civil partnership exists but what many people aren’t aware of is that the duty continues after separation as a result of statute. There is no automatic entitlement to spousal maintenance on divorce or dissolution.

Why do you have to pay your wife after divorce?

Alimony payments are designed to equalize the financial resources of a divorcing couple. Alimony is generally awarded in cases where the spouses have very unequal earning power and have been married a long time. If your ex gets laid off or refuses to pay, the creditors may come after you for payment. If you refuse to pay on the grounds that the debts “belong” to your ex-spouse, your credit will be damaged and the creditors may sue you. If you do pay the bills, your only remedy is to try and get your ex to reimburse you.

What happens if ex wife moves in with new partner?

If the wife subsequently moves in (cohabits) with a new partner this is likely to result in her ex-husband applying to vary the maintenance order under section 31 of the Matrimonial Causes Act 1973. The maintenance can be increased or decreased on variation and can also be capitalised to enable a clean break to take place.
