Is money inherited from a family trust taxable?

By Henry Morales |

If you inherit from a simple trust, you must report and pay taxes on the money. Any portion of the money that derives from the trust’s capital gains is capital income, and this is taxable to the trust. This is typically the case when the trust’s distributions for the year exceed the amount of income it took in.

Do I have to pay taxes when my parents die?

You don’t have to pay federal income taxes on money that you inherit from a decedent. However, as a general rule, the decedent’s estate will be subject to federal and state taxation prior to distribution of the inheritance money.

What are new tax rules for family trusts?

Under the New Rules, dividends paid by Opco to the trust and distributed by the trust to the business owner’s spouse and adult children will be subject to “tax on split income” (“TOSI”) and taxed at the top marginal rate (thereby eliminating any income splitting tax benefit), unless the family member qualifies for an exclusion from TOSI.

When does a parent get a tax benefit?

A similar tax benefit occurred when she inherited them. This “step-up” provision of the tax code makes a huge difference in the tax liability of these kinds of holdings.
