Should life insurance be included in a will?

By Olivia Norman |

Listing a life insurance policy in a will has no impact on either the policy or the will. For example, a will cannot change the beneficiary of a life insurance policy because the beneficiary is determined by the terms of the policy.

Can I use my will to distribute insurance proceeds?

The insurance proceeds also do not form part of your estate upon your death. This means that upon your death, the insurance proceeds will not be distributed by your executor(s) according to your will (as mentioned above).

Are life insurance proceeds protected from creditors?

In most cases, life insurance proceeds are exempt from creditors. Once your beneficiary receives your life insurance death benefit, those funds could be claimed by creditors seeking money they owe (depending on state regulations)

What happens to a life insurance policy if no one dies?

“But if none of the named beneficiaries are alive when the policyholder dies, then the proceeds are typically paid to the policyholder’s estate.”. Without a living life insurance beneficiary, the will now trumps the policy. This can easily happen if the life insurance policy was taken out many years before the death.

How are the proceeds of a life insurance policy taxed?

Section 2042 of the Internal Revenue Code states that the value of life insurance proceeds insuring your life are included in your gross estate if the proceeds are payable: (1) to your estate, either directly or indirectly or (2) to named beneficiaries, if you possessed any incidents of ownership in the policy at the time of your death.

Can a life insurance policy be paid to a beneficiary?

The same principle generally applies to other proceeds which may be paid directly to beneficiaries without being processed by your estate, such as superannuation benefits. Beneficiaries of life insurance policies are usually not required to pay any debts owed by the deceased estate, whether it’s secured or unsecured debt.

Can a life insurance policy be included in a will?

Generally, life insurance policies and health policies (as explained above) can be included in your will. However, it is advisable not to include insurance policies that have trust nominations, as will be discussed below.
