If a California employer accidentally overpays employees, it cannot simply withhold that amount from a later paycheck. In this situation, an employer has the right to sue you to get its money back, then garnish your wages for it if it wins in court.

What happens if your employer overpays you?

The federal Fair Labor Standards Act (1938) give companies the legal right to garnish an employee’s wages to reclaim overpayments. It is illegal for a California company to garnish your wages to recover overpayments.

Do you have to pay back money overpaid by employer?

“Unfortunately, if you are mistakenly overpaid by your employer you can be required to pay the money back,” explains Samantha Jenkins, legal adviser at DAS Law. “This is true even in cases whereby the employer realises their mistake sometime after the overpayment has been made, or where you have since left their employment.”

The employee promised to repay the overpayment and did not. The employee refuses to pay back the amount. The employer chooses to overlook the error and the employee keeps the payment. The overpayment was a matter of collusion between the employee and the employer and the employee does not give back the overpayment.

As has been said above you also have a legal right to proper pay slips etc. If they have indeed overpaid you they have a legal right to ask for the money back. This only becomes unenforcable after six years (5 in Scotland). As to whether they would take you to court I have no idea.
